[법인파산 및 법인회생절차에서 ‘외국법인’의 채권신고절차 대행기관]
Creditors must file a claim declaration with the rehabilitation court to secure their claims in corporate bankruptcy or corporate rehabilitation procedures.
But foreigners residing abroad or foreign corporations based overseas will face difficulties in taking appropriate measures, including the claim reporting process,
when bankruptcy or rehabilitation procedures of Korean corporations are initiated due to a lack of understanding of the Korean court bankruptcy system
as well as the difference in language.
However, in the application of this Act, foreigners and foreign corporations shall have the same status as that of peoples of the Republic of Korea or corporations of the Republic of Korea. Therefore, it is recommended that foreign corporations secure their rights by filing claims according to the rehabilitation procedure.
We will intervene in the entire process from reporting the claims of foreign corporate to collecting claims later to find the rights of foreign corporate as creditors.
채권자는 법인파산절차 또는 법인회생절차에서 자신의 채권을 확보하기 위해서 ‘회생법원’에 반드시 채권신고를 하여야 합니다.
그러나 해외에 거주하는 외국인이나 해외에 소재지를 둔 외국법인은 통용되는 언어의 차이뿐만 아니라 대한민국 법원의 파산제도에 대한 이해가 부족하여
대한민국 법인의 파산이나 회생절차가 개시되는 경우 채권신고를 비롯한 제반 절차에 적절한 대응을 하기 어렵습니다.
하지만 관련법의 적용에 있어 외국인 또는 외국법인은 대한민국 국민 또는 대한민국 법인과 동일한 지위를 가지므로,
외국법인도 필수적으로 관련 절차에 따른 채권신고를 하여 권리를 확보하는 것이 좋습니다.
